Question by melly180: How is it legal to sell marijuana products?
Yes I know they are considered “tobacco products,” but I’ve seen plenty of bongs or any other smoking product with marijuana symbols on it, so it’s clearly being sold for the purpose of consuming marijuana isn’t it? They have what would be considered cigarette rolling papers as “blunt wraps.” I’ve also heard you can purchase marijuana seeds in some tobacco shops. How is any of this legal?

the bongs are marketed to smoke tobacco out of thats why its legal technically at least the owner and the blowers know they are making the products for pot heads

    It’s a loophole in the law as long as vendors sell them for tobacco use only they cannot establish the intent of the buyer thus it is not illegal to sell them unless people know they are going to be used for marijuana specifically.

    well since their not actually selling marijuana its totality legal. like u said those products can be used for other purposes also.

    As you said, they cant prove its for marijuana. Lawmakers have at least some sort of common sense, and at least they realize that a place selling bongs is not going to contribute to more people smoking marijuana, since a bong is just a piece of plastic without marijuana in it, and anybody with marijuana can poke a few holes in a pepsi can and use that instead if they did outlaw them, or roll it.

    and no, you cant purchase marijuana seeds in tobacco shops. You can purchase full plants in medical marijuana clinics here in California though, of course, you would have to go to the doctor and get a prescription first.

    In the US it is illegal to purchase or sell marijuana for recreational use.
    This is federal law. It is also state law in all states.

    In California, the state can issue permits to individuals for the production of marijuana for sale for medical use in accordance with state regulation. In California, doctors can also prescribe it to patients for medical use.

    I am unaware if any other state has regulation similar to California’s.

    There is pending legislation in California right now [2009] to legalize marijuana for recreational use. It is estimated that sales tax collected on marijuana sales would bring in $ 1.6B to the state annually.

    However, federal law trumps state law. If the state initiative passes the federal government can override it and reverse the order. That is, the federal government can void the state law that would allow recreational marijuana use.

    There is no proof that they are selling it for marijuana specifically
    They can call it whatever they want and say it is for anything legal and its legit

    The seeds I’m not sure about and advise you to double check your sources but there are many marijuana stickers, shirts, etc. sold in stores. It’s considered supporting the cause for legalization and decriminalization or some other personal vendetta trying to be settled. Many stores say they don’t sell bongs; rather “tobacco water pipes” just for that reason, however knowing over 40% of high school students admit to having used marijuana and 25% of America saying they have experience with it, they advertise it by terms people know it. Tobacco water pipes (bongs) are better for a more milky smoke for tobacco and less chemicals getting to the lungs. Blunt wraps are used a lot for tobacco but again, a lot of people have experience with marijuana so it’s better for business.
